Cannabis Policy Issues

12/2/2022

Decriminalization
  • Cannabis decriminalization is a policy that reduces or eliminates criminal penalties for possession and use. It is different from legalization, which removes criminal penalties and creates a regulated market for cannabis.

Medical Cannabis Program
  • The use of cannabis for medical purposes is a major cannabis policy issue. Many people believe cannabis has therapeutic value and can treat various medical conditions.

Adult-Use Market
  • Adult-use cannabis legalization refers to the legal sale and possession of cannabis products for recreational purposes, rather than for medicinal or therapeutic use. 15 states and the District of Columbia have legalized cannabis, and many other states are considering it.

Other Issues
Workplace Protections
  • Workplace protections for cannabis patients refer to the rights and accommodations provided to employees who use cannabis for medical purposes, such as the right to use, possess, and discuss cannabis at work without discrimination.
  • These protections vary by state, with some states providing more comprehensive protections than others.
  • It is important for employers to respect the rights of employees who use cannabis for medical purposes and to stay informed about relevant laws and regulations.

Housing Protections
  • Housing protections for medical cannabis patients refer to the rights and accommodations provided to individuals who use cannabis for medical purposes in their residence, including the right to use, possess, and discuss cannabis without fear of discrimination or eviction.
  • These protections vary by state and can be limited by the federal prohibition of cannabis.
  • It is important for landlords and property management companies to respect the rights of tenants who use cannabis for medical purposes and to stay informed about relevant laws and regulations.

Impairment Testing vs Drug Testing
  • Drug testing for cannabis is another contentious policy issue.
  • Some employers require drug testing as a condition of employment, and many of these tests screen for the presence of THC, the psychoactive compound in cannabis.
  • This can pose a problem for people who use cannabis medically and may have THC in their system, as well as for those who live in states where cannabis is legal but may still be subject to drug testing by employers.
  • Impairment testing refers to the use of various methods to determine whether an individual is impaired by a substance, such as alcohol or drugs.
  • These methods may include standardized field sobriety tests, breathalyzers, and drug recognition evaluations (DREs).
  • The purpose of impairment testing is to determine whether an individual is impaired to the point where they are unable to safely operate a vehicle or perform other tasks that require a level of alertness and coordination.
  • In the context of cannabis legalization, it is important for states to have effective methods for determining impairment in order to ensure public safety.
  • However, it is also important for these methods to be fair and accurate, and not disproportionately impact certain groups of people.

Expungement
  • Expungement is the process of sealing or destroying the record of a criminal conviction and is an important part of cannabis reform because of the disproportionate impact the criminalization of cannabis has had on communities of color.
  • Expungement can help alleviate long-term consequences, such as difficulty finding employment and housing, and allow individuals with a cannabis-related conviction to move forward with their lives.
  • It also addresses the injustices of the war on drugs and helps to remedy the harm caused by the criminalization of cannabis, which has disproportionately targeted and punished marginalized communities.
  • In states that have legalized or decriminalized cannabis, expungement is often part of the reform process and should be made accessible and affordable for individuals seeking to clear their records.

Diversity, Equity and Inclusiveness
  • Diversity, equity, and inclusiveness (DEI) are important considerations in cannabis reform because the war on drugs has disproportionately impacted marginalized communities, particularly communities of color.
  • As states legalize and regulate the cannabis industry, it is important to ensure that DEI is at the forefront of these efforts.
  • This may involve ensuring that licenses for cannabis businesses are awarded to a diverse range of applicants, including those from communities that have been disproportionately impacted by the war on drugs.
  • In addition, DEI in cannabis reform may involve providing resources and support for individuals from marginalized communities to enter the cannabis industry, such as through training and education programs.
  • It may also involve implementing policies to ensure that the cannabis industry is accessible and welcoming to people of all backgrounds and identities.
  • DEI in cannabis reform is important not only for addressing past injustices and promoting equity, but also for the long-term success of the industry.
  • A diverse and inclusive industry is likely to be more innovative and successful, as it can draw on a wide range of perspectives and experiences.
  • Overall, DEI is a critical component of cannabis reform and should be incorporated into all aspects of the industry, from regulation and licensing to education and outreach.

Parental Rights
  • Protecting parental rights is important in cannabis reform because it allows parents to make decisions about their children's health and welfare, and helps to safeguard children from potential risks associated with cannabis use.
  • It is a fundamental aspect of family law and is necessary for the well-being and development of children. Cannabis reform may affect how parents are able to exercise their rights, so it is important to consider the impact on parental rights when making decisions about cannabis legalization and regulation.

Patient Rights
  • Protecting patient rights in cannabis reform is important because it allows patients to access medical treatment that is safe and effective for their needs, and it ensures that they can make informed decisions about their own health and well-being.
  • It is especially important for those who rely on cannabis for their health and well-being, and it helps to prevent discrimination and stigmatization of cannabis users.

Accessibility
  • Accessibility is important in a medical marijuana program because it ensures that patients who could benefit from medical cannabis can access it and use it for medicinal purposes.
  • Factors such as cost, availability, and ease of obtaining a medical marijuana card or prescription can affect accessibility, and if these are not properly addressed, it can negatively impact patients' health and well-being.
  • Ensuring accessibility can also help to prevent patients from turning to the illegal market, which can expose them to potentially dangerous products and decrease the effectiveness of the medical marijuana program.
